Biker launches £300,000 compensation claim

A MOTORCYCLIST whose life was ruined in a road accident involving a Walpole Cross Keys man has launched a legal battle for more than £300,000 compensation.

David Curtis (36) suffered severe traumatic brain injury in the accident almost three years ago and will never be able to work or live independently as a result of his injuries.

He is now suing through the Official Solicitor and is claiming damages from motorist Colin Harlock, whose Ford Fiesta collided with the Honda motorcycle Mr Curtis was riding.

A writ issued at London's High Court revealed that Mr Harlock, of Smugglers Rest, 54 Sutton Road, Walpole Cross Keys, was fined 500 and banned from driving for three months after pleading guilty to driving without due care and attention.

The writ states that Mr Curtis had been riding along Lynn Road from Wisbech when Mr Harlock's Fiesta pulled out of Bambers Nursery and turned right, causing the two vehicles to collide.

It is alleged that Mr Curtis, of East View, Gote Lane, Gorfield, near Wisbech, suffered severe multiple injuries in the crash, which left him with permanent physical, cognitive and behavioural disabilities.

He will always have to rely on others and will never be able to work due to his injuries.

The Official Solicitor is asking the court to award periodical payments, rather than a lump sum, and to order provisional damages allowing him to return to court if his condition deteriorates.

The writ says that Mr Harlock negligently failed to look left, drove out of a minor road onto a major road when it was unsafe, failed to wait until the motorcycle had passed, collided with the machine, failed to keep a proper lookout and failed to avoid the collision.

Although the writ does not specify a precise amount it indicates that lawyers value the claim, if successful, as being worth more than 300,000.
