Mistreated man they thought mistreated dog

TWO animal lovers attacked a man they believed was mistreating a dog, Lynn magistrates heard on Monday.

Malcolm Temperton (19), of 281 Hillington Square, Lynn, and Ashley Clark (19), of 187 Grimston Road, South Wootton, pleaded guilty to assault.

Temperton, who also took and crashed the victim's car, admitted aggravated vehicle taking, driving without insurance and without a licence. He was sentenced to a one- year community order including 120 hours unpaid work, banned from driving for a year and ordered to pay a total of 525 compensation.

Clark was conditionally discharged for a year and ordered to pay 75 compensation and 40 costs.

Kevin Eastwick, prosecuting, said the offence was committed in the early hours of New Year's Day.

The two men drove in Clark's car to Anmer Terrace in Lynn where they became involved in an altercation with a man.

Both assaulted the man causing bruising and swelling round his left eye. His car keys were also taken and Temperton drove away his car, lost control of the vehicle and crashed into a lamppost, said Mr Eastwick.

James MacWhirter, for Clark, said his client had not been in trouble before.

"This is an occasion where regrettably his commonsense was absent without leave," said Mr MacWhirter.

Clark believed a dog given to the victim was being mistreated and went to speak to him about it. The atmosphere degenerated into violence and Clark struck the victim two or three times about the head, said Mr MacWhirter.

Clark was in regular employment. "It's a real shame he is before the court today because he is a thoroughly solid, decent sort who perhaps let his temper get the better of him," said Mr MacWhirter.

James Burrows, for Temperton, said his client was particularly fond of dogs. He admitted throwing two or three blows in the victim's direction.

"He accepts it was not the most intelligent thing to do," said Mr Burrows.

"Temperton thought the car keys would be a good bargaining tool to exchange for the dog but the plan backfired and he took the car. He is very apologetic," added Mr Burrows.
