Nine months jail for Dino List
BUSINESSMAN Dino List has been jailed for nine months after he used proceeds from the sale of two properties to repay an unscrupulous businessman rather than clearing his debts.
List (51), of 2 Kenwick Hall Gardens, Station Road, Clenchwarton, appeared at Lynn Crown Court for sentencing yesterday after he earlier admitted two charges of making a gift, transfer or charge on property in a period of five years ending with the commencement of bankruptcy.
He had also admitted one charge of failing to notify the dispersal of a property.
Mr Cameron Brown, prosecuting, told the court List filed a petition for bankruptcy in December 2003 and owed the Inland Revenue 13,592 in income tax, while also having bank debts of 23,565.
When interviewed by the official receiver List provided details of a number of properties but failed to disclose a premises in Colney Court, Gaywood.
He also sold a property at Old Swan Wharf, in Battersea, London, which raised proceeds in the region of 96,000, and another in Railway Road, Downham, from which 24,000 was paid into his son's bank account.
When interviewed again, List said he used the money to repay loans to people in the north of England, but could not provide any contact details.
'LESS SCRUPULOUS'
Mr Tim Brown, defending, said List had made a failure to prioritise after he became engaged with people who were "less than scrupulous."
He added: "Mr List put the people who were impinging on him immediately ahead of his obligations to the state.
"It is quite clear that the money went to a recipient who should not have been first in the queue.
"The money went where he said it had gone. He would have to be a crystal ball conspirator to work out that he would be in trouble at this point and was putting money away.
"There is no evidence of him living a high life with money stashed away."
Mr Brown said List has since been declared bankrupt and is living in accommodation rented from his son while working as a furniture salesman.
List was given a nine-month sentence for each offence, which will run concurrent.
On passing sentence, Recorder Guy Ayres said: "You had debts totalling more than 37,000. You chose not to deal properly with those debts but when you came into money from the sales of properties the proceeds were used for purposes other than the Inland Revenue and the bank.
"Some money went to members of the family, other money went to unnamed people.
'COVERING UP'
"You have never been prepared to assist with names and addresses of those people to have them checked out in any shape or form.
"Your lack of providing detail leaves me with the conclusion that they do not exist or you are covering something more sinister.
"This is high level dishonesty with a significant sum of money and only custody can be justified."
