Three years' treatment after yob broke man's jaw

A VIOLENT yob who pushed a man off his bike, leaving the victim needing three years of treatment for a fractured jaw, has escaped an immediate prison sentence.

Jason Gurby was pushed off his bike by Lee Newson (20) and another youth in a "nasty attack" near Lynn's King Edward VII School last November.

He was left with a deep cut to his scalp, broken teeth and a fractured jaw and needed two months of hospital treatment, Norwich Crown Court heard on Wednesday.

An impact statement read by prosecutor Malcolm Robins said Mr Gurby's jaw will be wired for four to five months, before being re-broken and rewired so it can be straightened – a process that will need to be repeated over three years. He wasn't able to return to work until the beginning of January, and is now too scared to ride on his bike, said Mr Robins.

Newson, of 34 King George V Avenue, Lynn, admitted unlawfully wounding Mr Gurby, causing him grievous bodily harm on November 8.

The court heard the incident happened when Mr Gurby picked up some milkshake bottles and put them in the bin. Some youths shouted at him and Mr Gurby swore back.

Sentencing Newson to a nine-month prison sentence, suspended for two years, Judge Nicholas Coleman told him: "It was mindless, yobbish violence and the injury you caused was shocking. It was a nasty attack and no-one could complain if you went into custody."

Newson was also given a six-month curfew order banning him from leaving his home between 8pm and 6am daily and a community order for supervision for two years with a requirement to attend the aggression replacement therapy programme.

The court heard he had previous convictions for resisting a police officer, for using threatening behaviour and for being drunk and disorderly.

In mitigation, Katharine Moore said: "It was plainly unpleasant behaviour with terrible consequences. He is remorseful."
