Heacham man Dainius Smulkys sexually assaulted woman in Tesco, spat on neighbour’s doorbell and danced on road
A 35-year-old sexually assaulted a woman, spat in a neighbour’s doorbell and danced in the middle of the road during a month-long crime spree.
Dainius Smulkys, of Station Road in Heacham, appeared at Lynn Magistrates’ Court on Thursday.
He pleaded guilty to sexually assaulting a woman, having previously admitted offences of criminal damage to property and failing to comply with a community protection notice.
Magistrates, led by Terrance Geater, released Smulkys on conditional bail until November 29 for a pre-sentence report to be carried out by probation services. He will return to the Lynn court on that date, with the possibility of having his case committed to crown court.
On Thursday, crown prosecutor Nicola Lamb told the court that on August 16, Smulkys entered the Tesco Express store in Heacham and approached a woman in her 20s.
He was speaking in “broken English”, and left the store soon after. He returned 20 minutes later, and approached the woman again.
This time, he was carrying a small pot plant which he said was for the woman. It had a heart drawn on it, but the woman was in a state of “shock” and did not respond.
Smulkys returned to the Lynn Road supermarket for a third time, grabbing the woman around her waist and kissing her on the cheek. She pushed him away, and later described the ordeal as “completely unwanted”.
After what Ms Lamb described as a “prolonged incident”, the defendant left the store for the final time while “mumbling to himself”.
Then, on September 3, Smulkys damaged one of his neighbours’ doorbells having lived next to him for six months.
The neighbour reported that he had “ongoing issues” with Smulkys’ behaviour, which involved him banging his door and ringing the bell before running away.
On this occasion, the neighbour believed somebody had poured water into the doorbell – but upon closer inspection, it transpired that Smulkys had spat into it. This made the fellow resident’s “blood boil”.
Later on September 11, the defendant was drunk when the police witnessed him walking along the A149 at Heacham. He was stepping in front of traffic, and despite officers’ warnings, proceeded to move to an island in the middle of the road before starting to dance.
In mitigation, solicitor Charlotte Winchester asked for the case to be adjourned for a pre-sentence report to be carried out – something magistrates agreed with.
She also told the court that Smulkys has an alcohol addiction.
