Heacham man Dainius Smulkys sentenced in King’s Lynn court after harassing underage girl
A man who harassed underage girls by referring to them as “beautiful” and “sexy” will serve a community-based sentence.
Dainius Smulkys, 36, was sentenced at Lynn Magistrates’ Court on Thursday after previously pleading guilty to a series of offences.
They included harassing two underage girls, possession of drugs and breaching bail conditions.
After reading a pre-sentence report on Smulkys completed by the probation service, magistrates opted to revoke his existing community order and re-sentence him with a new one.
Smulkys, of Station Road in Heacham, was handed a 12-month order which will require him to complete 15 rehabilitation activity days and 150 hours of unpaid work - as well as wear an alcohol monitoring tag for 90 days.
A restraining order was also put in place which will prevent him from contacting one of his victims, who is aged under 18.
Among the offences Smulkys was sentenced for this week were breaches of bail conditions and an existing restraining order.
He also harassed a 17-year-old after cycling past her, describing her as “beautiful” and shaking her hand until she felt “extremely uncomfortable”.
On another occasion, he refused to let go of a 15-year-old girl’s arm and referred to her as “sexy”.
Then, he harassed another woman on a later date and was arrested. A search by police officers subsequently uncovered 3.97g of cannabis in Smulkys’ possession.
These offences were all committed between May 2023 and January this year.
When he appeared in court on Thursday, Smulkys was already serving a community-based sentence for a sexual assault he committed last year.
Mitigating, solicitor Charlotte Winchester said: “He has made significant progress in many, many areas.
“He accepts full responsibility for his behaviour. It is fair to say that at the time of these offences, Mr Smulkys was a very different man to the man you see in the dock.
“When I first saw him for these offences at the start of this year, he came to court in his dressing gown. He was very mentally unwell.
“He has been compliant with his medication and he has been working hard with the probation service.
“He knows the link between alcohol and his offending. He is now abstinent from alcohol.”
Smulkys will also pay a victim surcharge of £114 and £85 in court costs, while magistrates made an order for the drugs to be forfeited and destroyed.
Last year, as well as sexual assault, he was also before the court for offences such as criminal damage. One incident saw him turn up outside a nightclub wearing nothing but a towel.
